10. Service Availability

Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you to us in the twelve months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless Yieldbasis and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
14. Termination
You may terminate your account at any time through your account settings. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that should survive termination will remain in effect.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, Netherlands.
17. Miscellaneous
These Terms constitute the entire agreement between you and Yieldbasis regarding the Service. If any provision is found to be unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
